CONSULTATION TERMS OF SERVICE

For One-on-One Discovery Consult Sessions with Neural Revolution LLC

By booking a one-on-one Discovery Consult session (the “Session”) with Eliza Barach McCurdy of Neural Revolution LLC (“Company,” “we,” or “us”), you (“Client”) agree to the following terms:

1. SERVICE DESCRIPTION

 

The Discovery Consult session is a one-time, 30-minute private consultation conducted via phone call. The 30-minute Discovery Consult Session serves as a pre-cursor to a potential 1:1 Coaching relationship. This session aims to:

• Gauge the client-coach fit

• Assess the client's current situation

• Determine if coaching is the right intervention

• Provide foundational information about ADHD and the client's specific ADHD experiences

 

This session is not therapy, clinical mental health care, or a substitute for licensed medical or psychological services. If you are in need of such services, we encourage you to seek support from an appropriate provider.

 

 

 

2. TECHNOLOGY REQUIREMENTS
Client is solely responsible for ensuring they possess the necessary technology and a reliable internet or cellular connection to fully participate in strategy session. This includes, but is not limited to, having a functional device (computer, tablet, or smartphone), a stable and sufficient internet or cellular data connection, and familiarity with any required software or platforms. Technical difficulties experienced by the client will not be grounds for refunds, session rescheduling, or any other form of compensation.

 

 

 

3. FEE AND PAYMENT

 

The fee for the Discovery Consult is $50.00, due in full at the time of booking. By scheduling, you authorize the Company to charge your credit card, debit card, or other authorized payment method for this amount.

The $50.00 fee is non-refundable and non-transferable. However, if you elect to move forward with 1:1 ADHD Coaching following the Discovery Consult, the full amount of this fee will be applied as a credit toward your Intake Session fee, reducing the Intake Session cost from $250.00 to $200.00.

All payments are processed securely. Rescheduling requests are subject to the Company’s cancellation and rescheduling policies outlined in Section 5.

 

4. REFUND & CHARGEBACK POLICY

 

No chargebacks will be accepted under any circumstances. By booking your strategy session, you waive your right to initiate a chargeback with your bank or credit card provider. Any chargeback or payment dispute will be considered a breach of the terms of services, and we reserve the right to report the incident to credit bureaus or third-party databases. If you have a billing concern, please contact us at info@neural.revolution.com so we can resolve it directly.

 

 

 

5. CANCELLATION & RESCHEDULING

 

Client must provide at least 24 hours’ notice to reschedule a session. Missed sessions without the required notice will be forfeited. 

 

 

 

Clients who arrive 15 minutes or more late to a scheduled session will be considered a no-show, and the session will be forfeited. 

 

 

 

Excessive rescheduling (rescheduling the same session more than twice) may result in the forfeiture of that session at the Coach’s discretion. Repeated cancellations, no-shows, or delayed use of the scheduled session may be grounds for removal from the Coach’s caseload.

 

 

 

The Coach reserves the right to reschedule sessions due to unforeseen circumstances and will provide reasonable notice in such cases.

 

6. CONFIDENTIALITY

 

All information shared during the session will be treated as confidential. The Coach may consult with mentors or professional supervisors to improve service delivery; however, no personally identifying information will be disclosed in these consultations.

 

 

 

 

 

The Client understands and agrees that coaching is not a legally protected or privileged relationship (such as therapy or legal counsel), and while confidentiality is respected, it is not absolute under the law.

 

 

 

7. INTELLECTUAL PROPERTY

 

Any tools, worksheets, or resources shared during the session are the property of the Company and are provided for your personal use only. You agree not to share, distribute, or reproduce these materials without written permission.

 

8. LIMITATION OF LIABILITY

 

By participating in the Session, you acknowledge that outcomes are not guaranteed, and your results depend on your own actions. The Company’s total liability for any claim arising from this Session shall not exceed the fee paid.

 

 

 

9. NON-DISPARAGEMENT

 

Client agrees not to make any false, negative, or disparaging statements, whether written or verbal, about the Coach, Company, or strategy session, including but not limited to on social media, review platforms, or in public or private communications.

 

10. DISPUTE RESOLUTION

 

In the event of a dispute, Parties agree to first attempt mediation before pursuing legal action. Any legal disputes shall be governed by the laws of and resolved in a court located in Saratoga County, New York.

 

11. GENERAL PROVISIONS

 

11.1 Force Majeure
Neither party shall be liable for any failure or delay in performance due to causes beyond their control, including but not limited to natural disasters, government restrictions, or technical failures.

 

11.2 Severability and Waiver
If any provision of the terms of service is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. Failure by either Party to enforce any right or provision of the terms of service shall not constitute a waiver of future enforcement of that right or provision.

 

11.3 Survival
The provisions of the terms of service that by their nature should survive termination or expiration of the terms of service,  including but not limited to confidentiality, intellectual property, limitation of liability, indemnification, non-disparagement, and dispute resolution, shall survive and remain in full force and effect.
